Judge rules restaurant must close


De Revolution had already received an order from the city to cease operations for violating zoning laws.

GLENDALE — A Superior Court Judge on Monday ordered De Revolution, an Adams Square restaurant that the city filed a criminal complaint against for allegedly violating zoning laws, to cease operations.

The decision came at an arraignment hearing Monday, six days after the Glendale city attorney’s office filed a 13-count criminal misdemeanor complaint alleging that the business repeatedly operated in violation of its zoning-use certificate and sold alcohol without a conditional-use permit, said Dorine Martirosian, the deputy city attorney handling the case.

Three of the alleged violations occurred after the city issued its own cease-and-desist order on March 10, Martirosian said.

“I haven’t heard from them that they didn’t receive [the city’s order], but I don’t know that I can say they ignored it,” City Atty. Scott Howard said. “One can certainly speculate that they didn’t pay any attention to it, but it’s likely that they’re going to pay attention to what the judge ordered.”


De Revolution acquired permits in 2006 to operate a now-defunct deli and tobacco shop that occupied two side-by-side units in the Angela Plaza shopping center. The business owners have since knocked down the wall between the units and created a full-service restaurant, but never applied for the appropriate permits to operate a restaurant and sell alcohol.

The city attorney’s office sent a letter to the eatery on Jan. 23, giving the owners 30 days to attain a valid zoning-use certificate and conditional-use permit to sell alcohol. When that deadline came and went with no action, the city ordered the business to halt operations.

The city’s complaint alleges the restaurant operated at least three times in defiance of the order — a claim that Mary Der-Parseghian, an attorney representing the business, denies.

“We do refute that,” she said.

Another hearing is scheduled for May 16 in Glendale Superior Court, but in the meantime, Der-Parseghian said her client is making headway toward obtaining the necessary permits.

“I just need a couple of documents here and there, and we’re working closely and cooperating with the city for [De Revolution] to get at least their [zoning-use certificate] so they can operate as a restaurant,” she said. “This one is one of those backward cases where they had no idea where they had this problem. . . . It’s unfortunate, but people who are citizens get hit with these things, and they learn the hard way that they need to learn all the appropriate rules.”
